Organic Foods and Café Terms and Conditions

Introduction:
Welcome to Organic Foods and Café. We are the contractual appointed operator of the canteen and kitchen facilities at the German International School Dubai (DISD)

These are the terms and conditions governing our services to DISD and also your access to and use of the website http://webs.organicfoodsandcafe.com. By accepting these terms and conditions (including the linked information herein), and by using the Site, you represent that you agree to comply with these terms and conditions with Al Accad Department Stores (trading as Organic Foods and Café) (“we”, “us” or “Organic Foods and Café”) in relation to your use of the Site (the “User Agreement”).

This User Agreement is effective upon acceptance. If you do not agree to be bound by this User Agreement please do not access, register with or use this Site.

Before you may continue to register your child/children and book his/her/their meals, you must read, agree with and accept this terms and conditions.

We reserve the right and in cooperation with DISD governing body, to change and amend these terms and conditions. Any changes we make will be deemed to have come into effect on the date that they have been posted on the website.

You are responsible for reading the terms and conditions. When you place an order/book your child’s meal with us, you will be deemed to have read, understood and accepted these terms and conditions.

About us:
Organic Foods and Café (OFC) is a family run organic supermarket and café that sells fresh organic and biodynamic food, supplements, skincare, cosmetics, baby items and household cleaning products. We opened our first store in SATWA, Dubai in 2004. Organic Foods and Cafe currently supplies over 10,000 hormone and chemical free products direct from family run farms throughout the world. We do not buy from the open market, nor from traders. We have a selection of handpicked farmers whom we have personally visited (and regularly pay a visit to) and who have the same values we do.

We currently have three fully operational Organic Certified Cafés

Trading licence:
Trading License: Al Accad Department Stores is a sole proprietorship, and is a fully licensed company trading as Organic Foods and Café, a locally registered company governed by the laws of the UAE. All receipts, invoices and payment details will be made through Al Accad Department Stores.

General Terms and Conditions:
1. Registration Process:
A web site link plus username and password will be provided to all parents and send to their e-mail address as provided by the School registration office.

Parents need to register their children online by following the provided process to be able to start book meals.

Should you experience difficulty in registering and start the booking process please feel free to call the person responsible that will assist you with the process.

2. Child Identification:
In the daily collection of their meals the child/children should present their DISD identification card to be able to be served with his/her food.

Children without ID cards will have to be identified and verified via a printed booking list. This however should be prevented as it will the delay the serving of food to the other children.

3. Booking of Meals:
Only bookings that are done online via the online payment process, will be accepted.

Where parents exercise the option to book month by month will need to do their booking one month in advance and bookings for the next calendar month will close 2 weeks before the new calendar month starts.

Parents with more than one child should book meals separately for each child.

4. Cost and Payment:
The cost of meals for students in the secondary school and DISD School Staff are AED 23.10 per meal and for the DISD Kindergarten it is AED 14.70 per meal.

Payment is done on line via credit card or debit card into account as indicated via the link for booking meals. Parents can choose between monthly or term payment.

No cash payments for meals will be accepted by the staff at the serving counters.

Payments at the cafeteria and the vending machine will be cash

5. Discounts:
Where parents have three or more children enrolled at DISD, a 10% discount is applicable (if all the children book their meals) and as well as to the active School Staff.

6. Cancelation/Forfeiting of Payments:
Cancelation of bookings and refunds/credit will only be provided in cases of notification and confirmation via the School administration system and at least seven schooldays in advance.

Short notice will be possible, however the first 7 days of payment received will automatically be forfeited as ingredients and perishables has already been purchased.

After Cancellation of Order the customer will be eligible to get the refund after deduction 3% bank charges. Customers should mention in whose name they need the refund CHQ to be prepared.

Information with Customer cancellatin request should sent to finance for processing refund, it may take 15 to 20 working days for refund.

7. School Calendar and Timing:
The menu is in weekly cycles and will rotate every four weeks and the menu range will only change after the midterm break.

The school calendar as provided by the school will be applicable as well as the holidays as indicated on the calendar.

8. The Menu:
The parents agree that they accept the menu and the ingredients as posted on the weblink send to them. A dietician will be available online for questions at support diet@organicfoodsandcafe.com

9. Allergies:
It is the responsibility of the Parents to study the menu and ensure they understand the content/ingredients of meals and where their children are allergic to any foodstuff, to clarify it with the dietician to prevent any allergy shock situation.

OFC does not take any responsibility on the above as it is the parents responsibility to ensure allergy food identification and safety prevention.

10. Organic Standard:
Due to cost and to ensure that we meet the cost requirement of DISD, the parents hereby accept that the meals presented are 90% organic. The 10% non-organic ingrediency are listed and indicated in the ingredient list of each meal.

11. Food handling & HACCP Standards:
All staff handling and serving food will be compliant to the Dubai Municipality requirements and will carry a valid PIC identification with them.

The HACCP health and environment standards will be met and be maintained in the canteen and kitchen.

Children are responsible for their own personal hygiene

12. Communications and Complaint procedures:
Parents are welcome to communicate any suggestions and complaints via our online support.

Complaints will be addressed within 24 hours via email or direct phone calls from the appointed responsible person

General:
At Organic Foods and Café we will work hard to only deliver the freshest and best products, and to keep the items on the website up to date. Due to the nature of Organic foods, and the fact that we work with small family suppliers, some ingredients may change as it may be no longer be available

Should a product no longer be available between the time of placing the order and the time of presenting the food, parents will be informed by email and alternatives will be presented.

Privacy And Security Policy:
Organic Foods and Cafe is committed to protecting parent’s privacy and ensuring that all transactions are processed with utmost security. Organic Foods and Cafe does not store any credit/debit card information on its servers or database, all details will be processed to the payment gateway directly. Personal information will only be asked to ensure efficient processing of your order and will be saved in a secure database within Organic Foods and Cafe. Organic Foods and Cafe does not sell, trade, or rent any personal information to outside parties unless otherwise compelled by the law.

The security and privacy of your personal information is very important to us at Organic Foods and Cafe. We recognize that security is a major concern among on-line shoppers, and thus we employ state-of-the-art data encryption technology to protect the personal information submitted to us, both during transmission and once received.

Customer Information:
Other personal data; such as your login details, home address, e-mail and billing information, are stored in a highly secure system to ensure that all information you provide us with remains fully protected. Only those with proper authorization can view this data.

Passwords are stored on our servers using one-way encryption systems. We use SHA512 (Secure Hash Algorithm) – which is a cryptographic hashing algorithm that is considered unbreakable.

Foods and Café website including but not limited to, implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from the course of dealing or usage or trade. We make no warranty that the Organic Foods and Café website will meet your requirements or will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the site or the server that makes it available is free of viruses or bugs or represents the full functionality, accuracy, reliability of the materials.

We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Organic Foods and Café website. You acknowledge that we cannot guarantee and therefore shall not be in any way responsible for the security or privacy of the Organic Foods and Café website and any information provided to or taken from the Organic Foods and Café website by you.

Other Conditions:
We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the Conditions for: any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or any loss of goodwill or reputation; or any special or indirect or consequential losses; In any case whether or not such losses were within the contemplation of the parties at the date of the Conditions, suffered or incurred by that party arising out of or in connection with the provisions of any matter under the Conditions. Nothing in the Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees. By using this website service you agree to these terms and conditions of website use. Not withstanding any other provision in the Conditions, nothing herein shall limit your rights as a consumer under UAE law.
